Terms and Conditions

By accessing or using tepnyx.com, the Decider web app, the Decider app for iOS or Android, the online wheel, giveaways or Premium, you accept these terms. If you do not agree, do not use the services.

1. Provider

2. Services

  • Tepnyx website: information, account, giveaway search, participation, contact, online wheel and user panels.
  • Decider web: tool to create, run, verify and resolve giveaways with social requirements, including from a Twitch or YouTube live chat.
  • Decider for iOS and Android: app to create and enter giveaways, follow other users, comment, send messages, get notifications and use the wheel.
  • Premium: advanced Decider, wheel, customization, credits or benefit features described from time to time.

3. Registration, Age and Account

  • You must provide truthful information, keep it updated and protect your credentials.
  • You may not create fake, duplicate, automated accounts or accounts intended to manipulate giveaways.
  • You must notify us of any unauthorized access to your account.
  • You must be at least 13 years old. If your country requires an older age to use this kind of service or to consent to the processing of your data (14 in Spain), you need permission from a parent or guardian. Purchases by minors require that permission.
  • The date of birth you give must be your real one. Accounts of people under the minimum age are blocked.
  • We may suspend or delete accounts that breach these terms, the law or service security.

4. License

Tepnyx grants you a personal, limited, non-exclusive, non-transferable and revocable license to use the services under these terms. You do not acquire ownership rights over Tepnyx software, trademarks, designs, code, databases or content.

5. Acceptable Use

You may not:

  • Use the services for illegal, fraudulent, abusive, discriminatory activities or activities that infringe third-party rights.
  • Manipulate giveaways, create false entries, use bots, unauthorized automation or fake social accounts.
  • Interfere with the security, availability, APIs, technical limits or operation of Tepnyx or third parties.
  • Copy, modify, sell, rent, sublicense, reverse engineer, decompile or distribute the apps except as allowed by law.
  • Use the services for spam, phishing, malware, unauthorized scraping or unsolicited commercial communications.
  • Upload unlawful, offensive, misleading content or content that infringes intellectual property, privacy or image rights.
  • Harass, threaten, impersonate or send unwanted messages to other users through comments, mentions or private messages.

You can block and report other users. We review reports and may remove content or limit, suspend or delete accounts that breach these terms.

6. Giveaways and Contests

  • Creators or organizers are responsible for giveaway legality, rules, eligibility, taxes, permits, communication, prize and delivery.
  • Tepnyx provides technical infrastructure for creation, participation, verification and selection, but does not sponsor or guarantee third-party prizes unless expressly stated.
  • Participants must comply with giveaway rules and integrated platform terms.
  • Participation may require connecting social accounts to verify requirements. Verification is limited to the configured requirement.
  • We may invalidate suspicious, fraudulent, automated or non-compliant entries.
  • The winner is picked at random among those who meet the requirements; neither Tepnyx nor the creator chooses the result.
  • Requirements are checked when the winner is picked. Some can't be checked automatically (for example, private YouTube subscriptions or requirements written by the creator); in that case the creator decides.

7. Third-Party Integrations

Twitch, YouTube, Apple, Google, Stripe and other providers may apply their own terms and policies. We do not guarantee permanent availability of external APIs, permissions, stores, payment methods or integrations.

7.1 YouTube

  • Decider uses YouTube API Services. By connecting your channel you agree to the YouTube Terms of Service; Google processes your data under its Privacy Policy.
  • It's used to identify your channel, check subscriptions and comments required by a giveaway, read the creator's live chat and, when the creator chooses to, post the winner announcement in that chat.
  • It's not used to create, edit or delete videos or channel content, or for advertising.

7.2 Twitch

  • It's used to identify your account and check follows, subscriptions and roles on the creator's channel, read their live chat and, when the creator chooses to, send on their behalf the message announcing the winner.

8. Premium, Payments and Subscriptions

  • Premium unlocks additional features described in the website or app before purchase.
  • Prices, taxes, duration, renewal and conditions are shown before purchase confirmation.
  • On web, payments may be processed by Stripe or other certified providers. Tepnyx does not store full card data.
  • On iOS, purchases and subscriptions are managed through Apple App Store and governed by its terms.
  • On Android, purchases and subscriptions are managed through Google Play and governed by its terms.
  • Subscriptions renew automatically unless cancelled before the renewal period.
  • Premium belongs to your Decider account. An App Store or Google Play subscription is tied to the account it was bought with and can't be used on another account.
  • Deleting your account doesn't cancel an App Store or Google Play subscription: cancel it in the store.
  • You can cancel from your account, the relevant store or applicable provider. Access remains until the end of the paid period unless stated otherwise.
  • Payments already made are non-refundable unless required by law, store policy or payment provider decision.

9. App Store and Google Play Specific Terms

9.1 iOS

  • This agreement is between the user and Tepnyx, not Apple.
  • Apple is not responsible for the app, its content, maintenance, support, warranties or claims except as required by its rules.
  • The license allows you to use the Decider app on Apple devices you own or control under the Apple Media Services Terms and Conditions.
  • Apple and its subsidiaries are third-party beneficiaries of these terms with respect to the iOS app.
  • You state that you are not in a U.S.-embargoed country or on U.S. government restricted party lists.

9.2 Android

  • Google is not responsible for the Decider app, its content, support, warranties or claims except as required by Google Play.
  • Purchases, renewals, cancellations and refunds made on Android are managed through Google Play.

10. User Content

You keep your rights over content you upload or configure. You grant us a limited, worldwide, non-exclusive and royalty-free license to host, process, display and transmit that content only as needed to provide, protect and improve the services.

11. Privacy

Personal data processing is governed by the Privacy Policy, which forms part of these terms.

12. Availability, Changes and Beta

We may update, modify, suspend or remove features for maintenance, security, legal requirements, third-party changes or product evolution. Some features may be offered in beta, with errors, limits or changes without prior notice.

13. Warranties and Liability

The services are provided "as is" and "as available", without a guarantee of uninterrupted operation. To the maximum extent permitted by law, Tepnyx will not be liable for indirect damages, lost profits, data loss caused by matters outside our control, disputes between organizers and participants, third-party prize failures, external API outages or force majeure events.

14. Indemnification

You agree to hold Tepnyx harmless from claims arising from misuse of the services, your giveaways, your content, your legal breach or infringement of third-party rights.

15. Termination

You may cancel your account from the available settings or by contacting support. We may suspend or terminate accounts and feature access where there is breach, fraud, security risk, legal obligation or service abuse.

16. Governing Law and Jurisdiction

These terms are governed by Spanish law. Disputes will be submitted to the competent courts under applicable rules. EU consumers keep the mandatory rights recognized by their laws and may use available dispute resolution mechanisms.

17. Changes to Terms

We may update these terms. Relevant changes will be communicated through the website, app or email where appropriate. Continued use after the effective date means acceptance of the updated version.
