Terms and conditions

By accessing or using tepnyx.com, the Decider web app, the Decider app for iOS or Android, the Sorty app, the online wheel, giveaways or Premium, you accept these terms. If you do not agree, do not use the services.

1. Provider

2. Services

Tepnyx website: information, account, giveaway search, participation, contact, online wheel and user panels.
Decider web: tool to create, run, verify and resolve giveaways with social requirements, including from a Twitch, YouTube or Kick live chat.
Decider for iOS and Android: app to create and enter giveaways, follow other users, comment, send messages, get notifications and use the wheel.
Premium: advanced Decider, wheel, customization, credits or benefit features described from time to time.
Decider Bot: a Discord bot with stream and video alerts, giveaway announcements and, for servers, rules, moderation, welcomes, levels, role menus, tickets, suggestions, polls, scheduled messages and stat channels.
Decider Live: stream alerts in OBS from Twitch, Kick and YouTube events, with your own files (images, GIFs, videos and sounds) and filters for what viewers write.
Sorty for iOS and Android: an app that analyses your photo gallery on the phone itself and suggests what to delete (screenshots, duplicates, dark, blurry and receipts). Free and with no account.

3. Registration, Age and Account

You must provide truthful information, keep it updated and protect your credentials.
You may not create fake, duplicate, automated accounts or accounts intended to manipulate giveaways.
You must notify us of any unauthorized access to your account.
The services are not directed to children under 13. If you're under 13, your account works in a limited mode: you can view public giveaways and profiles, use the roulette, create giveaways by names published by invitation, and enter giveaways by names you're invited to. You can't comment, like, follow other accounts, send messages, connect other networks, request verification or buy paid plans. The limits are lifted automatically when you turn 13.
If your country requires an older age to use this kind of service or to consent to the processing of your data (14 in Spain), you need permission from a parent or guardian. Purchases by minors require that permission.
The date of birth you give must be your real one. If we learn that an account belongs to someone under 13, we switch it to the limited mode.
The country you set on your account must be yours, the country where you live. It can only be changed once a month. Setting another country to enter giveaways limited to that country is manipulating giveaways (section 5).
We may suspend or delete accounts that breach these terms, the law or service security, or limit only some actions (for example, publishing or entering certain kinds of giveaways) for a time. We'll email you about each limit and when it ends.

4. License

Tepnyx grants you a personal, limited, non-exclusive, non-transferable and revocable license to use the services under these terms. You do not acquire ownership rights over Tepnyx software, trademarks, designs, code, databases or content.

5. Acceptable Use

You may not:

Use the services for illegal, fraudulent, abusive, discriminatory activities or activities that infringe third-party rights.
Manipulate giveaways, create false entries, use bots, unauthorized automation or fake social accounts.
Interfere with the security, availability, APIs, technical limits or operation of Tepnyx or third parties.
Copy, modify, sell, rent, sublicense, reverse engineer, decompile or distribute the apps except as allowed by law.
Use the services for spam, phishing, malware, unauthorized scraping or unsolicited commercial communications.
Upload unlawful, offensive, misleading content or content that infringes intellectual property, privacy or image rights.
Harass, threaten, impersonate or send unwanted messages to other users through comments, mentions or private messages.

You can block and report other users. We review reports and may remove content or limit, suspend or delete accounts that breach these terms.

6. Giveaways and Contests

Creators or organizers are responsible for giveaway legality, rules, eligibility, taxes, permits, communication, prize and delivery.
Tepnyx provides technical infrastructure for creation, participation, verification and selection, but does not sponsor or guarantee third-party prizes unless expressly stated.
Participants must comply with giveaway rules and integrated platform terms.
Participation may require connecting social accounts to verify requirements. Verification is limited to the configured requirement.
We may invalidate suspicious, fraudulent, automated or non-compliant entries.
The winner is picked at random among those who meet the requirements; neither Tepnyx nor the creator chooses the result.
Requirements are checked when the winner is picked. Some can't be checked automatically (for example, private YouTube subscriptions or requirements written by the creator); in that case the creator decides.
Giveaways by country: the creator can limit a giveaway to accounts from one or more countries. It's checked against the account's country when entering. Tepnyx doesn't check where each person lives, and the creator may ask the winner to prove it before handing over the prize.
Winner message in the chat: with Premium, when the winner of a live-chat giveaway is confirmed, Decider posts in that chat, with the creator's connected account, the message the creator wrote for the giveaway or, if they wrote none, a sample one. The creator is responsible for what they write.
Where giveaways show: Tepnyx decides the order and visibility of giveaways in the feed and in search. Giveaways by names only show in the feed of the creator's followers, and in search when someone searches for the creator or the giveaway's name. Giveaways with a country requirement don't show in the feed to accounts from other countries. A giveaway can always be opened with its link and from the creator's profile.
Review against fake giveaways: every published giveaway goes through an automatic review with signals such as the account's age and history, reports, the giveaway's text and picture, or what its winners say (explained in the privacy policy). Depending on the result, the giveaway may show less in the feed and in search, or only to the creator's followers. That also happens if the account is less than 30 days old or hasn't connected any platform, if the prize doesn't say what it is, if any of its giveaways were removed or if several ended without a winner. In the giveaway's settings, the creator sees where it shows and why.
Review by the team: giveaways with the most signals are reviewed by a person on the Tepnyx team, who may approve them, add a visible warning that they might be fake, hide them or remove them. That warning is only ever added by a person, never by the automatic review. If you disagree with a decision, write to us from the contact form and we'll look at it again.
Verified accounts: their giveaways also go through the automatic review, but they're never limited automatically: if the review flags them, only the team looks at them.
Prize confirmation: some days later, Tepnyx may ask the winner whether they got the prize. The answer is taken into account in the review and isn't shown to the creator. Answering falsely is manipulating giveaways.

7. Third-Party Integrations

Twitch, YouTube, Kick, Apple, Google, Stripe and other providers may apply their own terms and policies. We do not guarantee permanent availability of external APIs, permissions, stores, payment methods or integrations.

7.1 YouTube

Decider uses YouTube API Services. By connecting your channel you agree to the YouTube Terms of Service; Google processes your data under its Privacy Policy.
It's used to identify your channel, check subscriptions and comments required by a giveaway, read the creator's live chat and, when the creator chooses to, post the winner announcement in that chat.
It's not used to create, edit or delete videos or channel content, or for advertising.

7.2 Twitch

It's used to identify your account and check follows, subscriptions and roles on the creator's channel, read their live chat and, when the creator chooses to, send on their behalf the message announcing the winner.

7.3 Kick

It's used to identify your account and check follows, subscriptions, roles and messages in the creator's channel chat, receive their channel's notifications (new followers and subscriptions, stream start and end) and, when the creator chooses to, send on their behalf the message announcing the winner.
Kick offers no official way to check whether someone follows a channel or is subscribed. Decider uses the public information Kick's website shows and the notifications Kick sends since the creator connected their channel; when it can't tell, the requirement is left for the creator to check by hand.

7.4 Discord and Decider Bot

Whoever adds Decider Bot to a server and sets it up is responsible for how they use it: the rules and messages it posts, moderation (warnings, timeouts, deleted messages, locked channels), the roles it gives out, and complying with Discord's terms and the law.
Tepnyx provides the tools, but does not moderate servers and is not responsible for their moderators' decisions. The message filter (AutoMod) is applied by Discord with its own limitations and may not catch everything.
The bot needs the permissions it asks for when added; without them, some features don't work. A server's settings belong to whoever last saved them among those who added the bot.

8. Premium, Payments and Subscriptions

Premium unlocks additional features described in the website or app before purchase.
There are three subscriptions: Decider Premium (Decider's Premium features), Decider Bot Premium (Decider Bot's Premium features in the subscriber's servers) and a bundle that includes both.
Decider Premium can be bought on the web (Stripe), on the App Store and on Google Play. Decider Bot Premium and the bundle are only sold on the web, through Stripe.
On the web you can change plan at any time: the difference for the current period is prorated and charged or credited right away, and from the next renewal the new plan's price applies.
Whoever had Decider Premium before October 13, 2026 keeps Decider Bot's Premium features at no extra cost for as long as that subscription continues without a break. If it ends, they'll need Decider Bot Premium or the bundle to get them back.
Decider Bot's Premium features in a server depend on the Premium of whoever saved its settings. If they lose it, the settings are kept, but those features stop applying until they get it back.
Prices, taxes, duration, renewal and conditions are shown before purchase confirmation.
On web, payments may be processed by Stripe or other certified providers. Tepnyx does not store full card data.
On iOS, purchases and subscriptions are managed through Apple App Store and governed by its terms.
On Android, purchases and subscriptions are managed through Google Play and governed by its terms.
Subscriptions renew automatically unless cancelled before the renewal period.
Premium belongs to your Decider account. An App Store or Google Play subscription is tied to the account it was bought with and can't be used on another account.
Deleting your account doesn't cancel an App Store or Google Play subscription: cancel it in the store.
You can cancel from your account, the relevant store or applicable provider. Access remains until the end of the paid period unless stated otherwise.
Payments already made are non-refundable unless required by law, store policy or payment provider decision.

9. App Store and Google Play Specific Terms

9.1 iOS

This agreement is between the user and Tepnyx, not Apple.
Apple is not responsible for the app, its content, maintenance, support, warranties or claims except as required by its rules.
The license allows you to use the Decider and Sorty apps on Apple devices you own or control under the Apple Media Services Terms and Conditions.
Apple and its subsidiaries are third-party beneficiaries of these terms with respect to the iOS app.
You state that you are not in a U.S.-embargoed country or on U.S. government restricted party lists.

9.2 Android

Google is not responsible for the Decider and Sorty apps, their content, support, warranties or claims except as required by Google Play.
Purchases, renewals, cancellations and refunds made on Android are managed through Google Play.

10. User Content

You keep your rights over content you upload or configure. You grant us a limited, worldwide, non-exclusive and royalty-free license to host, process, display and transmit that content only as needed to provide, protect and improve the services.

Files you upload to Decider Live must be yours or ones you're allowed to use on your streams (for example, licensed music or sounds), and must not be illegal, sexual, violent or hateful. We may remove files that breach these terms or that are reported to us with good reason. Decider Live's filters reduce the offensive things viewers write, but they can't stop everything: what shows on your stream is your responsibility, and you can adjust the filters or turn messages off.

11. Sorty

Sorty suggests photos you may want to delete based on an automatic analysis. It can be wrong: check what will be deleted before confirming, especially duplicates, where it suggests which one to keep.
Nothing is deleted without your confirmation in the system dialog. On iOS deleted photos go to “Recently Deleted”, where you can recover them for 30 days; on Android deletion is permanent. Back up what you don't want to lose.
You're responsible for what you choose to delete. To the fullest extent permitted by law, Tepnyx isn't liable for the loss of photos you confirmed deleting.
Sorty is a first version: some features may change, fail or be withdrawn. If something doesn't work well, tell us at soporte@tepnyx.com.
How Sorty handles your data is explained in section 11 of the Privacy Policy: your photos never leave the phone.

12. Privacy

Personal data processing is governed by the Privacy Policy, which forms part of these terms.

13. Availability, Changes and Beta

We may update, modify, suspend or remove features for maintenance, security, legal requirements, third-party changes or product evolution. Some features may be offered in beta, with errors, limits or changes without prior notice.

14. Warranties and Liability

The services are provided "as is" and "as available", without a guarantee of uninterrupted operation. To the maximum extent permitted by law, Tepnyx will not be liable for indirect damages, lost profits, data loss caused by matters outside our control, disputes between organizers and participants, third-party prize failures, external API outages or force majeure events.

15. Indemnification

You agree to hold Tepnyx harmless from claims arising from misuse of the services, your giveaways, your content, your legal breach or infringement of third-party rights.

16. Termination

You may cancel your account from the available settings or by contacting support. We may suspend or terminate accounts and feature access where there is breach, fraud, security risk, legal obligation or service abuse.

17. Governing Law and Jurisdiction

These terms are governed by Spanish law. Disputes will be submitted to the competent courts under applicable rules. EU consumers keep the mandatory rights recognized by their laws and may use available dispute resolution mechanisms.

18. Changes to Terms

We may update these terms. Relevant changes will be communicated through the website, app or email where appropriate. Continued use after the effective date means acceptance of the updated version.

The services are available in Spanish, English, Portuguese, French, German and Italian. These terms, the privacy policy and the cookie policy are published in Spanish and English; in the other languages the English version is shown. If the versions differ, the Spanish one prevails. Emails from the Tepnyx team may be automatically translated into your language; if a translation is unclear, you can ask us for the original.
